Another legal win for former President Trump who just survived an assassination attempt yesterday.

Harvard emeritus constitutional attorney Alan Dershowitz says Judge Aileen Cannon found that the appointment of special counsel Jack Smith violated the Constitution.

Dershowitz called this was the most winnable of the four cases against Trump. An appeal would mean the matter will be eventually being contemplated by the US Supreme Court.

And the legal scholar believes this case will not be retried because a new prosecutor would not be able to get up to speed before the November presidential election.

Dershowitz says Cannon's decision to dismiss will be appealed and eventually will be decided by the Supreme Court. He adds that the dismissal of the Florida case has implications for Trump's DC case as well.

This is the second legal victory for Trump who also was handed a victory by the US Supreme Court which recently ruled that a president has both civil and criminal immunity for their official acts.

The former president faced 40 charges for allegedly mishandling handling classified documents after leaving office and allegedly obstructing the Justice Department's investigation. The former president and his aides Walt Nauta and Carlos de Oliveira were charged in an alleged scheme to impede the federal probe, and all three pleaded not guilty.

Smith's office did not immediately respond to a request for comment and the status of Nauta's case is not known.
